I'm not entirely sure if it's legal or not...But put it this way:
1.) People play Stepmania for free
2.) People like the dancing game idea
3.) People buy Dance mats (Konami makes some money)
4.) People buy PS2 versions (Konami gets a little $)
5.) People get better at the dance games
6.) People move on to the arcade (Konami scores an assload of quarters)
So really Konami is getting a ton of free advertising from it. I know they've made their fair share of money off me....(That thing I just wrote explains it) |

Fixed for you. Konami gets paid for the arcade cabinet, but the arcades get to keep the revenue. |

They did (successfully) sue Andamiro once Pump It Up hit the scene (Andamiro has to pay royalties to Konami), and I'm waiting for when they sue Roxor Games for In The Groove (which is a much more blatant rip-off than PIU ever was). |

A lil bit of a tangent here but I recently got wind of a school using Stepmania and two metal pads and have set up a ddr system. Apparenly they charge and right now im assuming theyre using official songs. I'm just wondering what the legalities of this are. _________________

I am sure that KOA is aware of StepMania and Dance With Intensity, but since, technically, the artwork has completely been redesigned (doesn't say DDRMAX anymore, but SMMAX), it isn't violating any copyright issues.
It could be also violating copyright issues because all of the Production BGM of SM are the official DDR bgm, I guess it could be violating copyright issues.
Like I was saying, KOA is aware of StepMania, and since "the game is an open-source simulator" and it comes with no songs, the legallity of stepmania is totally dependat on you.

Actually, the reverse would be true. If Wikipedia had an acceptable use policy restricting the use of the image, then the only step missing is licence from KoA. Since StepMania uses obviously derivitave images that are close enough to be considered infringement (noteskins, some bg music, characters, certain images) with no limitations on use, then it's the same as illegally downloading an MP3 and distributing it (kudos to the reference to that above). _________________

Responding to old posts, yay!
It's gray area, really. StepMania does have the coin system (check the Options out sometime), and it's open source... but the only way they would be 100% legal is if they made the songs from 100% original content, created the banners, backgrounds, etc. Then, since they're using open-source software and original content, they're fine to charge people. If you want to go a bit further, the metal pads would need to be homebuilt. However, since they aren't, it's TECHNICALLY not legal. However, unless Konami/the metal pad creators/the simfile creators decide to get angry and sue, nothing'll happen. _________________

Playing stepmania just makes you want to play the actual game on your feet, whether it be ITG or DDR so stepmania might as well be an advertisement for DDR. |

Doesn't Stepmania (and in fact all the other sims too) fall squarely under the category of copyright violation? It's a pretty blatant rip off of DDR, you have to admit. If you look at patterns for other companies...I mean Blizzard had Freecraft shut down (C&D order) just because it was capable of similar gameplay to their Starcraft/Warcraft games.

The reason why its legal is because konami sued the itg people for making itg. The itg people one the lawsuit. Therefore since itg was based off of stepmania its not illegal yo. |

In The Groove intellectual property is now owned by Konami. Roxxor made an out of court settlement. That is why their is no itg 2 home version, itg 3, and no new cabinets... |
